All rights reserved.We present new observations of the low-mass companion to HD 984 taken with the Gemini Planet Imager as a part of the GPI Exoplanet Survey campaign. Images of HD 984 B were obtained in the J and H bands. Combined with archival epochs from 2012 and 2014, we fit the first orbit to the companion to find an 18 au orbit with a 68% confidence interval between 14 and 28 au, an eccentricity (...) of 0.18 with a 68% confidence interval between 0.05 and 0.47, and an inclination of 119°with a 68% confidence interval between 114°and 125°. To address the considerable spectral covariance in both spectra, we present a method of splitting the spectra into low and high frequencies to analyze the spectral structure at different spatial frequencies with the proper spectral noise correlation. Using the split spectra, we compare them to known spectral types using field brown dwarf and low-mass star spectra and find a best-fit match of a field gravity M6.5 ±1.5 spectral type with a corresponding temperature of K. Photometry of the companion yields a luminosity of log=2.88 ± 0.07 dex with DUSTY models. Mass estimates, again from DUSTY models, find an age-dependent mass of 34 ±1 to 95 ±4 M Jup. These results are consistent with previous measurements of the object. (shrink)

Presenting a novel account of singular thought, a systematic application of recent work in the theory of speech acts, and a partial revival of Russell's analysis of singular terms, this book takes an original approach to the perennial problems of reference and singular terms by separating the underlying issues into different levels of analysis.

In recent years there has been an explosion of published literature utilising Multi-Agent-Based Simulation (MABS) to study social, biological and artificial systems. This kind of work is evidenced within JASSS but is increasingly becoming part of mainstream practice across many disciplines.

Powerful emotion and pursuit of self-interest have many times led people to break the law with the belief that they are doing so with sound moral reasons. This study is a comprehensive philosophical and legal analysis of the gray area in which the foundations of law and morality clash. This objective book views these oblique circumstances from two perspectives: that of the person who faces a possible conflict between the claims of morality and law and must choose whether or not (...) to obey the penal code; and that of the people who make and uphold laws and must decide whether to treat someone with a moral claim to disobey differently from ordinary lawbreakers. In examining the extent of the obligations owed by citizens to their government, Greenawalt concentrates on the possible existence of a single source of obligation that reaches all citizens and all laws. He also discusses techniques of amelioration of punishment for conscientious lawbreakers, asking how far legal systems should go to accomodate individuals who break the law for reason of conscience. Drawing from numerous examples of conflicts between law and morality, Greenawalt illustrates in detail the positions and predicaments of potential lawbreakers and lawmakers alike. (shrink)

Due to COVID-19’s strain on health systems across the globe, triage protocols determine how to allocate scarce medical resources with the worthy goal of maximising the number of lives saved. However, due to racial biases and long-standing health inequities, the common method of ranking patients based on impersonal numeric representations of their morbidity is associated with disproportionately pronounced racial disparities. In response, policymakers have issued statements of solidarity. However, translating support into responsive COVID-19 policy is rife with complexity. Triage does (...) not easily lend itself to race-based exceptions. Reordering triage queues based on an individual patient’s racial affiliation has been considered but may be divisive and difficult to implement. And while COVID-19 hospital policies may be presented as rigidly focused on saving the most lives, many make exceptions for those deemed worthy by policymakers such as front-line healthcare workers, older physicians, pregnant women and patients with disabilities. These exceptions demonstrate creativity and ingenuity—hallmarks of policymakers’ abilities to flexibly respond to urgent societal concerns—which should also be extended to patients of colour. This paper dismantles common arguments against the confrontation of racial inequity within COVID-19 triage protocols, highlights concerns related to existing proposals and proposes a new paradigm to increase equity when allocating scarce COVID-19 resources. In light of recent doctrinal changes, we examine the confused state of U.S. insider trading law, identifying gaps that permit certain market participants to trade on the basis of material nonpublic information, and contrast U.S. insider trading doctrine with the European approach. We then explore the ethical implications of the status quo in the U.S., explaining why the dominant legal justifications for prohibiting classical insider trading and misappropriation—the fiduciary duty and property rights theories—fail to account for the wrongfulness of insider (...) trading by eavesdroppers and certain tippees. We refute common arguments for legalizing insider trading, including arguments that insider trading is a victimless crime and that the practice promotes efficiency. We explain why insider trading constitutes the moral wrong of cheating, grounding our theory in the legitimate expectations of market participants. Having considered Kantian deontology in other work, we find that virtue ethics theory offers a helpful albeit rough framework for assessing the morality of insider trading independent of its legality. We also find that social contract theories, with norms of equality of opportunity and moral desert, provide a compelling ethical basis for retaining, clarifying and broadening current legal prohibitions against insider trading. Newton certainly regarded his second law of motion in the Principia as a fundamental axiom of mechanics. Yet the works that came after the Principia, the major treatises on the foundations of mechanics in the eighteenth century—by Varignon, Hermann, Euler, Maclaurin, d’Alembert, Euler (again), Lagrange, and Laplace—do not record, cite, discuss, or even mention the Principia’s statement of the second law. Nevertheless, the present study shows that all of these scientists do in fact assume the principle that the Principia’s second (...) law asserts as a fundamental axiom in their mechanics. (For what that second law asserts, we rely on Newton’s own testimony.) Some, like Varignon and Hermann, assume the axiom implicitly, apparently unaware that any assumption is being made, while others, like Maclaurin and Euler, assume the axiom explicitly, apparently unaware that the assertion assumed is the second law as Newton himself understood it. But in every case these scientists employ the principle asserted by the Principia’s second law fundamentally, unaware that they should be citing Neutonus, Prin., Phil. Nat. Math., Lex II. (shrink)

Philosophers writing on the subject of human action have found it tempting to introduce their subject by raising Wittgenstein's question, 'What is left over if you subtract the fact that my arm goes up from the fact that I raise my arm?' The presumption is that something of particular interest is involved in an action of raising an arm that is not present in a mere bodily movement, and the philosopher's task is to specify just what this is. Unfortunately, such (...) an approach does not take us very far, since a person could properly be said to raise his (or her) arm while asleep or hypnotized even though he (or she) would not be performing an action in the sense of 'action' with which philosophers are particularly concerned. To avoid this kind of difficulty I shall approach the subject of human action is a more academic way: I shall expound some important rival theories of human action, and introduce the relevant issues by commenting critically on those theories. One of the issues I eventually introduce is a metaphysical one. A theory of action makes sense, I contend, only on the assumption that there are such 'things' as actions (or events). After considering some key arguments bearing on the issue I conclude that, as matters currently stand in philosophy, a metaphysically noncommittal attitude toward actions and events seems justified. Public health involves the use of power to change institutions and redistribute resources and deliberately to shape individual thought and behavior. This requires normative legitimation and demands ethical critique. This article explores concepts that are vital to public health ethics, but have been relatively neglected. These are membership, solidarity and the concept of place. The article argues that the practice of public health should recognize the equal rights of membership in communities of health justice. Public health should also rely on (...) a sense of obligation and mutual aid in a world of shared vulnerability and reciprocal recognition. Finally, public health achieves its goals not merely—and perhaps not most fundamentally—through information and altering the logical ratiocination of individuals or groups, but rather through the reformation of sense and sensibility. This book is an argument for the importance of diversity in society. It is not naive, in the sense that it does not argue that any diversity is helpful, but rather tries to distinguish some of the ways in which it can be helpful and, hence, some the conditions under which it can be helpful. It does this is a largely non technical language and using informal argument using argument, examples and a review of the evidence to support its conclusions. (...) More than sixty reporters discuss ethical dilemmas facing the journalist and how they have personally coped with such problems as conflicts of interest, gifts, bribes, news leaks, and confidentiality of sources.

This essay does not aim to investigate film-novel relationships per se, although the fact that the two genres now share certain generative procedures may be further evidence that fiction in print and on film lie to a great extent in a unified field not only of diegesis but also of structure. A diachronic or historical approach to the theory of fictional generators would show that, with the shifts which have occurred on present-day aesthetic thought, much of what once was considered (...) to be a static analysis of retrospective rules or established forms could now be regarded as the disguised beginning of generative theory. Aristotle's seemingly static doctrines of dramatic structure, involving such notions as peripeteia, discovery, or unity of action, to the extent that dramatists had consciously or unconsciously followed such doctrines, obviously served the production of their works, as well as their later analysis. In fact, any sort of artistic intentionality constitutes a kind of "generator," as does the deliberate adherence to outward forms as rhyme schemes, stanzas, cantos, or chapters. As we shall see, it is not always easy to distinguish between generative formulas and self-imposed forms or limits, such as the sonnet with its fourteen lines, its quatrains, and its tercets. Although the most advanced practitioners of generative theory, like Jean Ricardou, seem to view their work as a radical break with the past and the discovery of an entirely new domain of fiction, literary history would provide innumerable examples of precedents, from antiquity through the Grands Rhétoriqueurs, the Gongorists and Baroque poets, and many subsequent groups of writers down to and including the pre-modern and modern periods. Bruce Morrissette has published widely on French fiction of the classical period, Rimbaud and the Symbolist movement, the Nouveau Roman and Robbe-Grillet, and on contemporary film. He is the Sunny Distinguished Service Professor and Chairman of Romance Languages and Literatures at the University of Chicago. Current debate on business ethics in Australia continues apace as the excesses of the 1980s are exposed. Codes of Ethics have been a high profile instrument in the American business scene. A survey of Australia''s largest business corporations reveals a different situation. Codes are not as commonly used, tend to refer to legal requirements and do not have as high a profile within the corporation. Given the changing legal framework in Australia a greater role for Codes of Ethics may emerge.

Concentrating on the era when American academic philosophy was nearly equated with Harvard, the ideas, lives, and social milieu of Pierce, James, Royce, Whitehead, and others are critically analyzed.

This is a review article of two recent, complete translations of the Arabian Nights, in French by André Miquel and Jamel Eddine Bencheikh and in English by Malcolm Lyons, respectively.

Michael Almeida, in his book "Freedom, God, and Worlds" (OUP 2012) argues that (C) Necessarily, God has available an infallible method, Unrestricted Actualization, by which God can bring about whatever undetermined events God chooses, except those which it is metaphysically or accidentally necessary that God does not bring about. I argue that we have no reason to believe either of the two premises of Almeida's main argument for (C).

Two essential elements of free will—internal locus of control and confident self-efficacy—have been studied extensively by psychologists but neglected by philosophers. As a result of this neglect, philosophers have worked with a distorted view of free will. Existentialists exaggerate internal locus of control while undercutting self-efficacy; most contemporary philosophers have taken both internal locus of control and self-efficacy for granted, ignoring their importance and the problems generated by their absence. By taking advantage of psychological research on internal locus of control (...) and self-efficacy, this paper develops a richer and more realistic account of the value of free choice and the real threats to free will. The right to teach at university is a distinctive philosophical and legal conundrum but a largely unexplored question. Drawing on Humboltdian principles, the legitimacy of the university teacher stems from their continuing engagement in research rather than possession of academic and teaching qualifications alone. This means that the right to teach needs to be understood as a privilege and implies that it is always provisional, requiring an ongoing commitment to research. Yet, massification of higher education systems internationally has led to (...) the disaggregation of the academic profession with teaching-only positions now increasingly common. University teachers employed to both teach and research face a narrowing set of performative expectations with respect to how ‘research-active’ is defined. This paper challenges these contemporary understandings and, drawing on historical evidence, argues that a broader definition of research and scholarship needs to underpin the basis of the right to teach. Public debates rage on about the extent to which the character of political candidates should be examined in the public media. This study examines attitudes of newspaper editors, and finds that their attitudes appear to approximate those of the public. A substantial number of editors felt that too much public attention is paid to these matters, yet there was a recognition of demand. As in office gossip, people want to hear these things, but the teller loses some credibility.

In the September 2020 edition of Perception, Alan Gilchrist published an editorial entitled “The Integrity of Vision” (Gilchrist, 2020). In it, Gilchrist critiques motivated perception research. His main points are as follows: (1) Motivated perception is compromised by experimental demand: Results do not actually show motivated perception but instead reflect subjects’ desires to comply with inferred predictions. (2) Motivated perception studies use designs that make predictions obvious to subjects. These transparent designs conspire with experimental demand to yield confirmatory but compromised (...) results. (3) Motivated perception research lacks guiding theory and cannot explain what appear to be contradictory results. (4) Motivated perception presents an unsupportable assault upon the impermeability of perception. The present commentary responds to these four assertions. (shrink)

Abstract:In the following essay I attempt a Schellingian response to the question of what it means to do philosophy in anticipation of civilizational collapse and the end of nature as we know it. As early as 1804 Schelling foresees how the spirit of modernity would lead to what he called “the annihilation of Nature,” but he also advanced a host of ideas that speak directly to our current dilemma. Most importantly for our purposes he held that every significant idea is (...) always as ethical as it is metaphysical: “the highest speculative concepts” must always be “simultaneously the most profound ethical concepts” (II, 3, 67). Ontology, epistemology, logic, aesthetics must all be understood ethically, a point which is seen most clearly in the demand for thoroughgoing systematic unity: the highest speculative concept of unity that must be informed by the most profound ethical experience of the unity of nature which alone can sanctify the positive meaning philosophy must engender if it is to transform human consciousness by increasing awareness of our nature as nature. Such a transformed awareness founds his call for a new way of thinking and doing philosophy that would be as different from the modern as the modern was from the ancient; as ancient referred to the past and, etymologically ‘modern’ denotes the present, he argues for a new way of thinking directed by the ethical tense of the future, in which the absolute becomes the future understood as that which should be (das Seinsollende). To anticipate, I posit the normativity of nature which, as the sustainer of the relational web of the living world, supplies the absolute value to orient humanity’s future. This requires an ecstatic ontology as well as an ethics and epistemology which unite in an erotics of the earth that, by integrating the immediate and sensuous reality of living nature, opens us to a more dynamic way of doing philosophy; one whose primary mode is more haptic than ocular, working by feeling and touch more than abstraction and sight, as it returns love to wisdom and elevates the future to determine the present. While epistemic justification is a central concern for both contemporary epistemology and philosophy of science, debates in contemporary epistemology about the nature of epistemic justification have not been discussed extensively by philosophers of science. As a step toward a coherent account of scientific justification that is informed by, and sheds light on, justificatory practices in the sciences, this paper examines one of these debates—the internalist-externalist debate—from the perspective of objective accounts of scientific evidence. In particular, we focus on Deborah Mayo’s (...) error-statistical theory of evidence because it is a paradigmatically objective theory of evidence that is strongly informed by methodological practice. We contend that from the standpoint of such an objective theory of evidence, justification in science has both externalist and internalist characteristics. In reaching this conclusion, however, we find that the terms of the contemporary debate between internalists and externalists have to be redefined to be applicable to scientific contexts. (shrink)
